Trademark infringement would be a civil issue to be persued privately either in a state or federal court. Typically, an attorney is retained and a "cease-and-desist" letter is sent to the offenders, warning them they are infringing on a trademark, demanding they cease use of the trademark and refrain from using it again in the future. These are usually backed up by a slight threat to take the issue in front of a judge.
